FairPath Terms & Refunds — DRAFT for solicitor review

Solicitor to confirm: (1) the digital-content withdrawal mechanics under the Consumer Rights Act 2022 / EU Consumer Rights Directive as applied to the two-moment pack delivery (and that the consent-to-immediate- supply tick is captured and time-stamped at checkout); (2) liability cap enforceability; (3) governing-law and consumer-forum wording.

Who you're dealing with. FairPath is a registered business name of Compound Life Ltd, a company registered in Ireland (CRO no. 788749), registered office 53 Moatfield Road, Coolock, Dublin 5, D05 C9H3. Contact: hello@fairpath.ie.
What FairPath is. FairPath is a preparation service for the Nursing Homes Support Scheme ("Fair Deal"). We turn your answers into a completed application pack, a document checklist, and tools for your family to manage the process.
What FairPath is not. We do not submit applications — your family signs and submits, and remains the applicant throughout. We are not the HSE and are not affiliated with it. We do not provide legal, tax, or financial advice, and nothing in the product is a substitute for it. All figures we show are estimates from the published scheme rules; the HSE's own assessments are final, and we do not guarantee any outcome, timeline, or funding decision.
Your side of it. The application's accuracy is your family's responsibility: you confirm the information you enter is true and complete, and you check the generated pack before signing. Knowingly giving the HSE false information is an offence — our validation exists to help you get it right, not to replace your review.
The price. The Family File is a one-off payment of €229 for one applicant's application, covering the whole family's access. No subscription, no renewal. (Compound Life Ltd is not currently registered for VAT, so no VAT is added — the price is the total you pay.)
Refunds
- Within 14 days of purchase, before your final pack is generated: refund on request (your statutory withdrawal right) — email hello@fairpath.ie from the address on your account, stating the name on the purchase. Refunds are processed within 2 business days of verification, to your original payment method.
- Generating the final pack requires ticking a consent box acknowledging that this supplies the digital content immediately and ends the statutory withdrawal period.
- After generation: if something in your pack is wrong or not as described, tell us within 14 days and we will correct it. A refund applies where we cannot put it right.
- Outside these windows, refunds are at our discretion, decided case-by-case against your file's activity record.
- If circumstances change — the person no longer needs care, or a bereavement — contact us whatever the timing; these are handled with discretion and decency, always.
One Family File covers one applicant's journey; refunded purchases that are repeated may be reviewed before re-supply.
Service & liability
We aim to keep the service available continuously but do not guarantee uninterrupted access; we may suspend briefly for maintenance. Our total liability to you is limited to the amount you paid us, except where liability cannot lawfully be limited. Nothing in these terms limits your statutory consumer rights under Irish law.
Fair use. One purchase covers one applicant's Fair Deal journey. Accounts used to prepare applications commercially for multiple unrelated families require our written agreement.
Complaints & governing law
If something's wrong, email hello@fairpath.ie and we'll try to put it right. If we can't resolve it, EU consumers may also use the European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr). We may update these terms; material changes will be notified to account holders. These terms are governed by the laws of Ireland, and disputes are subject to the jurisdiction of the Irish courts, without prejudice to your rights as a consumer.
